1. Introduction
Welcome to Workimia, a digital platform operated by WorkWave Ltd., a company incorporated under the laws of Ireland, with its registered address at Glencoe, Carnmore West, Oranmore, Co. Galway, Eircode H91T2RF.
Access to, registration with, and use of the Workimia platform (hereinafter, the “Platform”) constitutes full and unconditional acceptance of these Terms and Conditions of Use (hereinafter, the “Terms”).
If you do not agree with any of the provisions set out below, you are requested not to use the Platform.
2. Definitions
- Workimia: the company that owns and administers the digital platform.
- User: any natural or legal person who registers to request or obtain professional services.
- Professional / Freelancer: any natural or legal person offering professional services through the Platform.
- Services: lawful and professional activities offered or obtained through Workimia.
- Account: the individual profile created by each User or Professional.
- DPO (Data Protection Officer): the Data Protection Officer appointed by Workimia.
- Lead: a service request generated by a Client, to which Professionals may apply using credits.
- Credits: virtual units used by Professionals to apply for service requests.
- Subscription: the monthly membership purchased by Professionals to access the Platform and obtain credits.
3. Purpose of the Platform
Workimia is a technology intermediation platform that connects users seeking professional services with freelancers or independent service providers offering such services.
Workimia is not a direct contractual party between the User and the Professional. Its role is limited to acting as a technological intermediary, facilitating communication and service management.
4. Registration and Account Creation
- Registration on the Platform is free of charge and voluntary.
- Users and Professionals must provide truthful, current, and complete information during registration and keep such information up to date.
- Workimia may request additional documentation (for example, identification, certifications, or proof of address) as part of the verification process.
- Each user is responsible for maintaining the confidentiality of their login credentials.
- Use of and registration on the Platform is strictly limited to individuals aged 18 years or over, without exception.
5. Obligations of Users and Professionals
Users and Professionals agree to:
- Comply with applicable laws, Workimia’s internal policies, and these Terms.
- Use the Platform solely for lawful and authorised activities.
- Not publish false, offensive, defamatory, unlawful content or content that infringes third-party rights.
- Not use the Platform for money laundering, financing illicit activities, or manipulating payments.
- Respect intellectual property rights and personal data protection regulations.
6. Intermediation, Payments and Liability
- Workimia acts solely as a technological intermediary and does not intervene in the contractual relationship between Users and Professionals.
- Payments and charges are processed through certified payment service providers in accordance with applicable financial regulations in Ireland and the United Kingdom.
- Workimia shall not be liable for:
- The performance or quality of the services provided by the Professional.
- Any direct or indirect damages arising from the relationship between the parties.
- Workimia may retain commissions, apply service charges, or administrative fees, which will be duly disclosed at the time of the transaction.
7. Regulatory Compliance and AML/CFT
- Workimia implements internal Anti-Money Laundering and Counter-Financing of Terrorism (AML/CFT) policies.
- Users and Professionals agree that their data may be verified through Know Your Customer (KYC) procedures.
- Workimia may temporarily suspend an account or report suspicious activities to the Financial Intelligence Unit (FIU) Ireland or the National Crime Agency (NCA), in accordance with applicable regulations.
8. Personal Data Protection
- Workimia complies with the General Data Protection Regulation (GDPR – EU 2016/679) and the UK Data Protection Act 2018 (UK GDPR).
- Personal data is processed in accordance with the Privacy Policy, available in the relevant section of the Platform.

9. Intellectual Property
- All content, software, designs, logos, texts, databases, and elements of the Platform are the exclusive property of WorkWave Ltd. or its licensors.
- Reproduction, distribution, or modification without express authorisation is strictly prohibited.
- Professionals retain intellectual ownership of their own work unless expressly assigned to the end client.
10. Confidentiality
- Users and Professionals agree to maintain confidentiality regarding all information obtained in connection with the services.
- Any unauthorised use of information shall be considered a serious breach and may result in account suspension or termination.
11. Suspension or Termination of Accounts
Workimia may suspend or terminate the accounts of Users or Professionals who:
- Breach these Terms or Compliance Policies.
- Engage in fraudulent or unlawful activities.
- Damage the reputation or security of the Platform.
Suspension may be temporary or permanent and shall not give rise to any right to compensation.
12. Limitation of Liability
To the maximum extent permitted by law:
- Workimia shall not be liable for loss of profits, loss of data, or indirect damages.
- Workimia’s total liability in relation to any claim shall not exceed the total amount of fees paid by the user during the previous six (6) months.
13. External Links and Third-Party Services
The Platform may contain links to third-party websites or services. Workimia is not responsible for the content or policies of such sites. Users are advised to review their Terms and Privacy Policies before use.
14. Amendments to the Terms
Workimia may update these Terms whenever deemed necessary.
Amendments will be published on the Platform and shall enter into force from the date of publication.
Continued use of the Platform constitutes acceptance of the updated Terms.
15. Governing Law and Jurisdiction
These Terms shall be governed by the laws of Ireland and, where applicable, the laws of the United Kingdom, depending on the territorial scope in which the user operates.
Disputes shall be resolved through institutional arbitration or mediation before the Irish Commercial Court or the London Court of International Arbitration (LCIA).
